Considera la Corte que el Juzgado Penal Especializado respetó y acató lo dispuesto en el Decreto 2591 de 1991 al remitir el expediente a la oficina de reparto, al considerar que quien debía surtir la segunda instancia era el superior jerárquico funcional del Juzgado Cincuenta y Cinco Penal Municipal con Función de Garantías.

DEJAR SIN EFECTOS el auto del 9 de noviembre de 2017 proferido por el Juzgado Treinta y Cinco Penal del Circuito con Funciones de Conocimiento de Bogota, dentro de la accion de tutela instaurada por el senor Jorge Adelmo Guzman Romero, a traves de agente oficioso, contra Capital Salud EPS-S.
- Segundo. REMITIR el expediente ICC-3140 al Juzgado Treinta y Cinco Penal del Circuito con Funciones de Conocimiento de Bogota que contiene la accion de tutela presentada por el senor Jorge Adelmo Guzman Romero, a traves de agente oficioso, para que, de manera inmediata, desate la impugnacion presentada.
- Tercero. Por la Secretaria General de la Corte Constitucional, COMUNICAR a las partes y al Juzgado
